SENATE BILL NO. 274

A BILL FOR AN ACT ENTITLED: "AN ACT PROHIBITING THE SALE OF FEDERAL LAND IN MONTANA; REPEALING SECTIONS 77-2-401, 77-2-402, AND 77-2-403, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Sale of federal land prohibited. (1) Except as provided in subsection (2), land in the state that is owned or controlled by an agency of the United States government may not be sold.

     (2) This section does not apply to:

     (a) lands owned or held by any Indian or Indian tribes pursuant to Article 1 of the Montana constitution; or

     (b) lands to which the United States has exclusive jurisdiction pursuant to Article 1, section 8, clause 17, of the United States constitution.

 

     NEW SECTION.  Section 2.  Repealer. The following sections of the Montana Code Annotated are repealed:

77-2-401.        & #160; Sale or transfer of federal land -- when hearing required.

77-2-402.        & #160; Hearing requirements.

77-2-403.        & #160; Action by director.

 

     NEW SECTION.  Section 3.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 2, chapter 1, and the provisions of Title 2, chapter 1, apply to [section 1].

 

     NEW SECTION.  Section 4.  Effective date. [This act] is effective on passage and approval.
