A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING EVERY APPLICANT FOR A COMMISSION AS A NOTARY PUBLIC IN MONTANA TO PASS AN EXAMINATION; AMENDING SECTION 1-5-620, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 1-5-620, MCA, is amended to read:

     "1-5-620.  Examination of notary public. (1) An Every applicant for a commission as a notary public who does not hold a commission in this state shall pass an examination administered by the secretary of state or by an entity approved by the secretary of state. The examination must be based on the course of study described in subsection (2).

     (2)  The secretary of state or an entity approved by the secretary of state shall offer regularly offer a course of study to applicants who do not hold commissions individuals applying for a commission as notaries a notary public in this state. The course must cover the laws, rules, procedures, and ethics relevant to notarial acts."

 

     NEW SECTION.  Section 2.  Effective date. [This act] is effective on passage and approval.
