HOUSE BILL NO. 397

A BILL FOR AN ACT ENTITLED: "AN ACT REVISING POLLING PLACE HOURS; AMENDING SECTION 13-1-106, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 13-1-106, MCA, is amended to read:

     "13-1-106.  Time of opening and closing of polls for all elections -- exceptions. (1) Except as provided in subsections (2) and (3), polling places must be open from 7 a.m. to 8 p.m.

     (2)  A polling place having If, as of 25 days before the election, a polling place has fewer than 400 registered electors, excluding electors who have requested an absentee ballot or registered late pursuant to 13-2-304, the polling place must be open from at least noon to 8 p.m. or until all registered electors who are not absentee electors or late registrants in any precinct have voted, at which time that precinct in the polling place must be closed immediately.

     (3)  If an election is held on the same day as a school election and is conducted in the same polling place, the polling place must be opened and closed at the times set for the school election, as provided in 20-20-106."

 

     NEW SECTION.  Section 2.  Effective date. [This act] is effective on passage and approval.
