A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING THE DEPARTMENT OF ENVIRONMENTAL QUALITY TO REVIEW WATER QUALITY RULES RELATED TO SUBDIVISIONS; REQUIRING THE BOARD OF ENVIRONMENTAL REVIEW TO ADOPT RULES; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Review of nondegredation rules for subdivisions -- reporting -- rulemaking. (1) The department of environmental quality shall review rules pertaining to nondegradation requirements as applied to the effects on surface water of wastewater discharges to groundwater from subdivisions reviewed pursuant to Title 76, chapter 4.

     (2) The department shall evaluate potential categories of discharges from subdivisions that have nonsignificant effects on surface water because of their distance from surface water, their low potential for harm to human health or the environment, and their conformance with the criteria in 75-5-301.

     (3) By March 15, 2018, the department shall present to the board of environmental review the results of the review required by this section and recommend rules.

     (4) By May 15, 2018, the board shall publish a notice of proposed adoption of the rules to implement recommendations from the department as a result of the review.

 

     NEW SECTION.  Section 2.  Effective date. [This act] is effective on passage and approval.
