A BILL FOR AN ACT ENTITLED: "AN ACT ALLOWING A LANDLORD TO REQUEST THE COURT TO COLLECT PERIODIC PAYMENTS FROM A TENANT TO SATISFY A JUDGMENT AGAINST THE TENANT; REQUIRING A TENANT MAKING PERIODIC PAYMENTS TO PROVIDE NOTICE TO THE COURT OF CHANGES IN RESIDENCE OR EMPLOYMENT; REQUIRING THE COURT TO MAKE PAYMENTS TO THE LANDLORD UNTIL THE JUDGMENT IS PAID IN FULL; AND ALLOWING THE COURT TO RETAIN A PROCESSING FEE FOR PAYMENTS MADE TO THE LANDLORD."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Judgment against tenant -- notice of change of employment or residence -- payments to court on behalf of landlord required. (1) When a court enters a judgment for a landlord and against a tenant pursuant to a provision in Title 70, chapter 24:

     (a) at the landlord's request, the court shall order the tenant to make payments to the court within a specified period of time in specified installments until the judgment is satisfied; and

     (b) the tenant shall provide notice to the court within 14 days after any change in the tenant's residence or employment.

     (2) The court shall make periodic payments to the landlord from the money collected from the tenant until the judgment is paid in full, minus any processing fees collected pursuant to subsection (3).

     (3) The court may keep $10 from the money collected from the tenant for each payment made to the landlord as a processing fee to offset costs associated with collecting money from the tenant on behalf of the landlord.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 70, chapter 24, part 4, and the provisions of Title 70, chapter 24, part 4, apply to [section 1].
