AN ACT TO ELIMINATE THE REQUIREMENT THAT PUBLIC UTILITIES REPORT MINOR INJURIES TO THE PUBLIC SERVICE COMMISSION; AMENDING SECTION 69-3-107, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Section 69-3-107, MCA, is amended to read:

     "69-3-107.  Investigation and reports of accidents. (1) The commission, some member thereof of the commission, or some person deputed by it shall investigate and make inquiry into every accident occurring in the operation of any public utility in this state resulting in death or injury to any person of such gravity as to require that requires 3 days or more of hospitalization. The report of the accident shall must be filed in the office of the commission.

     (2)  It is hereby made the duty of every A public utility operating within this state, shall promptly upon the occurrence of any accident in the public utility's operation and resulting in death or injury to any person of such gravity as to require that requires hospitalization, to report the accident within the next 2 business days, followed by a written report in which shall be stated that states the time and place of the accident, the names of persons killed or injured, and in concise form the nature and cause of such the accident. For any other accident occurring in a public utility's operation and resulting in injury, a public utility shall submit a written report to the commission within the 20 days after the occurrence of the accident. The commission shall prescribe forms for the purpose of making such these written reports."



     Section 2.  Effective date. [This act] is effective on passage and approval.
