A BILL FOR AN ACT ENTITLED: "AN ACT ALLOWING A BOARD OF COUNTY COMMISSIONERS TO DESIGNATE ROADS UNDER ITS JURISDICTION AS ADJUNCTS TO THE LEWIS AND CLARK HIGHWAY; PROVIDING FUNDING FOR SIGNS AND ROAD MODIFICATIONS FROM THE PROCEEDS OF THE LODGING FACILITY USE TAX ALLOCATED TO THE REGIONAL NONPROFIT TOURISM CORPORATION THAT INCLUDES MISSOULA COUNTY; AND AMENDING SECTION 60-1-202, MCA."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Section 60-1-202, MCA, is amended to read:

     "60-1-202.  Lewis and Clark highway. (1) There is hereby established the Lewis and Clark highway. It shall be is composed of the following existing routes:

     (1)(a)  from the Idaho state line west of Lolo Hot Springs, Montana, to the junction with U.S. highway 93 at Lolo;

     (2)(b)  thence then north from Lolo on U.S. highway 93 to Missoula;

     (3)(c)  thence then east from Missoula on U.S. highways 12 and 10 to Garrison;

     (4)(d)  thence then east from Garrison on U.S. highway 12 through Forsyth and Baker to the North Dakota state line.

     (2) A board of county commissioners may designate a road under its jurisdiction as an adjunct route of the Lewis and Clark highway if the road constitutes a route used by Meriwether Lewis or William Clark."



     NEW SECTION.  Section 2.  Funding. (1) Funds in the amount of $20,000 that are received, as provided in 15-65-121(1)(e), by the regional nonprofit tourism corporation containing Missoula county must be granted by the regional nonprofit tourism corporation to the Missoula county commissioners for signs, other appropriate designations, and road modifications for purposes of establishing and marking an adjunct to the Lewis and Clark highway, as provided in [section 1].

     (2) The adjunct funded by this section includes the segment of Blue Mountain Road from U.S. highway 93 to the junction of O'Brien Creek Road and River Road.

     (3) The Missoula county commission may transfer grant funds to the department of transportation to perform the road modifications and signing, as the department is authorized to do under 60-2-242, or the county commission may contract with a private entity to perform the work.
