A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING THE STATE TO IMPLEMENT A QUALIFIED TESTING PROGRAM TO TEST FOR THE PRESENCE OF CONTROLLED SUBSTANCES AND ALCOHOL; REQUIRING THE QUALIFIED TESTING PROGRAM TO TEST PROSPECTIVE NEW PUBLIC OFFICERS AND EMPLOYEES AS A CONDITION OF HIRE; REQUIRING THE QUALIFIED TESTING PROGRAM TO PROVIDE FOR TESTING BASED UPON A SUSPICION OF IMPAIRMENT ON THE JOB, BECAUSE OF A JOB-RELATED ACCIDENT, OR BECAUSE THE INDIVIDUAL IS RANDOMLY SELECTED; AND PROVIDING AN EFFECTIVE DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Qualified testing program. The state shall implement a qualified testing program as provided for in Title 39, chapter 2, part 2. The qualified testing program must apply to all branches of government. The qualified testing program must contain the provisions provided for in 39-2-208. The random selection provision of 39-2-208 applies only to individuals elected or hired on or after July 1, 1999.



     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 2, chapter 18, part 1, and the provisions of Title 2, chapter 18, part 1, apply to [section 1].



     NEW SECTION.  Section 3.  Effective date. [This act] is effective July 1, 1999.
