A BILL FOR AN ACT ENTITLED: "AN ACT SUBMITTING THE FORKLIFT OPERATOR LICENSE RENEWAL FEE TO THE ELECTORATE; PROVIDING A CONTINGENT VOIDNESS PROVISION; AND PROVIDING AN EFFECTIVE DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Renewal of license -- notice -- fee. (1) A license issued by the department is valid for 24 months from the date of issue by the department and may be renewed by payment to the department in the amount established in subsection (3).

     (2) The department shall issue a notice to each licensee 30 days or more prior to the expiration of the license, warning the licensee of the expiration date and that failure to renew the license renders the license void.

     (3) The license renewal fee is $40 for each 24-month period subsequent to the first issuance of the license.



     NEW SECTION.  Section 2.  Submission to electorate. This amendment shall be submitted to the qualified electors of Montana at the tax election to be held in 1999 by printing on the ballot the full title of this act and the following:

SHALL A NEW TAX, DESCRIBED AS FOLLOWS, BE IMPOSED?

     [] FOR imposing a forklift operator license biennial renewal fee of $40.

     [] AGAINST imposing a forklift operator biennial license renewal fee of $40.



     NEW SECTION.  Section 3.  Contingent voidness. (1) If Constitutional Initiative No. 75, enacting Article VIII, section 17, of the Montana constitution, is declared invalid, then this act is void.

     (2) If LC 1747 is submitted to and not approved by the electorate, then this act is void.



     NEW SECTION.  Section 4.  Effective date. This act is effective July 1, 1999.
