A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING FOR LONGEVITY SALARY INCREASES FOR FULL-TIME PUBLIC DEFENDERS; PROVIDING AN APPROPRIATION; AND PROVIDING AN EFFECTIVE DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Longevity pay for public defenders. After completing 4 years of service as chief public defender, chief deputy public defender, or deputy public defender, each qualifying public defender is entitled to an increase in salary of $1,000 on the anniversary date of the public defender's employment. After completing 5 years of service as chief public defender, chief deputy public defender, or deputy public defender, each qualifying public defender is entitled to an additional increase in salary of $1,500 on the anniversary date of the public defender's employment. After completing 6 years of service as chief public defender, chief deputy public defender, or deputy public defender and for each year of service after 6 years and up to the 11th year of service, each chief public defender, chief deputy public defender, or deputy public defender is entitled to an additional annual increase in salary of $500 on the anniversary date of the public defender's employment.



     NEW SECTION.  Section 2.  Appropriation. There is appropriated from the general fund to the office of the supreme court administrator $57,000 for the fiscal year beginning July 1, 1999, and $57,000 for the fiscal year beginning July 1, 2000, for the payment of longevity salary increases for public defenders as provided in [section 1], to be paid through the district court criminal reimbursement program provided for in 3-5-901.



     NEW SECTION.  Section 3.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 46, chapter 8, part 2, and the provisions of Title 46, chapter 8, part 2, apply to [section 1].



     NEW SECTION.  Section 4.  Effective date. [This act] is effective July 1, 1999.
