A BILL FOR AN ACT ENTITLED: "AN ACT ALLOWING AN ELECTRICAL APPRENTICE WHO HAS COMPLETED RELATED INSTRUCTION AND JOB TRAINING HOURS TO TAKE A LICENSURE EXAMINATIONS EXAMINATION BEFORE THE APPRENTICESHIP EXPIRES; AMENDING SECTION 37-68-314, MCA; AND PROVIDING AN EFFECTIVE DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Section 37-68-314, MCA, is amended to read:

     "37-68-314.  Qualifications for licensing examination -- when no discretion in board -- examination during apprenticeship allowed. A person applying for a license as a journeyman electrician or a residential electrician must be allowed by the state electrical board to take the required examination and be granted a license upon passing the examination if the person has:

     (1)  he has completed an appropriate training program conducted by a bona fide union;

     (2)  he has completed the appropriate required apprenticeship; or

     (3)(1)  he has worked in the electrical field for 10 years and is considered by his the person's employer, as shown by a written statement of the employer, to be capable and qualified to take the examination for the license for which he the person is applying;

     (2)  completed a state or federal registered apprenticeship program; or

     (3)  completed the related instruction and the mandatory job training hours within a state or federal registered apprenticeship program. Upon completion of the requirements in this subsection, the apprentice must be allowed to apply for and take the required examination ONCE while registered as an apprentice, but shall comply with the time restrictions for examinations adopted by the board by rule pursuant to 37-68-201."



     NEW SECTION.  Section 2.  Effective date. [This act] is effective July 1, 1999.
