A BILL FOR AN ACT ENTITLED: "AN ACT SUBMITTING TO THE ELECTORATE THE ELIMINATION OF THE TERMINATION DATE FOR THE CIVIL FILING FEES FOR FILING OF PETITIONS FOR DISSOLUTION OF MARRIAGE AND SEPARATION FOR FUNDING OF THE PARTNER AND FAMILY MEMBER ASSAULT INTERVENTION AND TREATMENT FUND ACCOUNT; REPEALING SECTION 14, CHAPTER 484, LAWS OF 1997; PROVIDING A CONTINGENT VOIDNESS PROVISION; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Repealer. Section 14, Chapter 484, Laws of 1997 is repealed.



     NEW SECTION.  Section 2.  Submission to electorate. This act shall be submitted to the qualified electors of Montana as provided in Title 13, chapter 1, MCA, at the tax election to be held in 1999, by printing on the ballot the full title of this act and the following:

SHALL THE DOMESTIC VIOLENCE SERVICES SURCHARGE TAX BE INCREASED ANNUALLY BY $0 IN THE FOLLOWING MANNER?

[] FOR continuing the surcharge on filing of pleadings in dissolution and separation proceedings for funding of domestic violence shelters, crisis lines, and other services.

     [] AGAINST continuing the surcharge on filing of pleadings in dissolution and separation proceedings for funding of domestic violence shelters, crisis lines, and other services.



     NEW SECTION.  Section 3.  Contingent voidness. If Constitutional Initiative No. 75, enacting Article VIII, section 17, of the Montana constitution, is declared invalid, then this act is void.



     NEW SECTION.  Section 4.  Effective date. [This act] is effective on passage and approval.
