A BILL FOR AN ACT ENTITLED: "AN ACT SUBMITTING TO THE ELECTORATE THE GENERIC SPECIALTY LICENSE PLATE ADMINISTRATIVE FEE; PROVIDING A CONTINGENT VOIDNESS PROVISION; AND PROVIDING AN EFFECTIVE DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Fees for generic specialty license plates -- disposition. (1) In addition to the other fees and taxes imposed by law, an eligible person who applies for a generic specialty license plate shall pay an administrative fee of $23. The county treasurer shall, upon receipt of the fee:

     (a) deposit $10 of the fee in the county general fund; and

     (b) remit $13 of the fee to the state general fund, with $3 of the amount to be allocated to the department of corrections for the purposes provided for in 53-30-132(1)(k).

     (2) An applicant for a generic specialty license plate sponsored by a state agency shall pay to the county treasurer the donation required by the state agency. The county treasurer shall remit the entire amount of the donation to the state treasurer for deposit in either the state general fund or the state special revenue fund to the credit of the sponsoring state agency.

     (3) If an additional donation is required by a state agency for renewal of generic specialty license plates sponsored by the state agency, the additional donation must be paid to the county treasurer upon renewal and remitted to the state agency as prescribed in subsection (2).

     (4) The county treasurer shall also collect from an applicant any donation required by a sponsoring local government, school district, or political subdivision if a written agreement exists between the county treasurer and the sponsoring local government, school district, or political subdivision. The agreement must:

     (a) authorize the collection of the donations by the county treasurer;

     (b) specify the amount of donation required for issuance and renewal of the generic specialty license plates; and

     (c) provide for the disbursement of the revenue.



     NEW SECTION.  Section 2.  Submission to electorate. This act shall be submitted to the qualified electors of Montana at the tax election to be held in 1999 by printing on the ballot the full title of this act and the following:

SHALL A NEW TAX, DESCRIBED AS FOLLOWS, BE IMPOSED?

     [] FOR a $23 generic specialty license plate applicant administrative fee to offset costs incurred by county and state governments.

     [] AGAINST a $23 generic specialty license plate applicant administrative fee to offset costs incurred by county and state governments.



     NEW SECTION.  Section 3.  Contingent voidness. If Constitutional Initiative No. 75, enacting Article VIII, section 17, of the Montana constitution, is declared invalid, then this act is void.



     NEW SECTION.  Section 4.  Effective date. If approved by the electorate, this act is effective January 1, 2000.
