A BILL FOR AN ACT ENTITLED: "AN ACT INCREASING THE RESIDENT UPLAND GAME BIRD LICENSE FEE BY $4; SUBMITTING THE FEE INCREASE TO THE ELECTORATE; PROVIDING A CONTINGENT VOIDNESS PROVISION; AMENDING SECTION 87-2-401, MCA; PROVIDING AN EFFECTIVE DATE; AND PROVIDING A TERMINATION DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Section 87-2-401, MCA, is amended to read:

     "87-2-401.  Class A-1--resident upland game bird license. Except as otherwise provided, a resident, as defined by 87-2-102, who is 12 years of age or older may, upon payment of a fee of $6 $10, receive a Class A-1 license that entitles the holder to hunt upland game birds and possess the carcasses of upland game birds as authorized by department rules."



     NEW SECTION.  Section 2.  Submission to electorate. This act shall be submitted to the qualified electors of Montana at the tax election to be held in 1999 by printing on the ballot the full title of this act and the following:

SHALL THE RESIDENT UPLAND GAME BIRD LICENSE FEE TAX BE INCREASED ANNUALLY BY $4 IN THE FOLLOWING MANNER?

     [] FOR increasing the resident upland game bird license fee to $10 BY $4 and using the increase to encourage public access to private lands for hunting purposes.

     [] AGAINST increasing the resident upland game bird license fee to $10 BY $4 and using the increase to encourage public access to private lands for hunting purposes.



     NEW SECTION.  Section 3.  Contingent voidness. (1) If Constitutional Initiative No. 75, enacting Article VIII, section 17, of the Montana constitution, is declared invalid, then this act is void.

     (2) If LC 560 is not passed and approved, then this act is void.



     NEW SECTION.  Section 4.  Termination. [This act] terminates March 1, 2006.



     NEW SECTION.  Section 5.  Effective date. If approved by the electorate, this act is effective March 1, 2000.
