AN ACT REVISING THE INCOME TAX CHECKOFF SYSTEM BY REDUCING FROM $20,000 TO $10,000 THE THRESHOLD AMOUNT THAT TRIGGERS TERMINATION OF CERTAIN TAX CHECKOFFS; AMENDING SECTION 12, CHAPTER 581, LAWS OF 1993, AND SECTION 1, CHAPTER 12, LAWS OF 1995; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE AND A RETROACTIVE APPLICABILITY DATE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Section 12, Chapter 581, Laws of 1993, is amended to read:

     "Section 12. Contingent termination. A voluntary income tax checkoff created in 15-30-150, 15-30-152, or 15-30-155 terminates on January 1 of the first tax year following the 2 immediately preceding tax years in which the voluntary checkoff raises less than $20,000 $10,000 in each of those 2 tax years."



     Section 2.  Section 1, Chapter 12, Laws of 1995, is amended to read:

     "Section 1. Section 12, Chapter 581, Laws of 1993, is amended to read:

     "Section 12. Contingent termination. A voluntary income tax checkoff created in 15-30-150, 15-30-152, or 15-30-155 terminates on January 1 of the first tax year following the 2 immediately preceding tax years in which the voluntary checkoff raises less than $20,000 $10,000 in each of those 2 tax years.""



     Section 3.  Effective date. [This act] is effective on passage and approval.



     Section 4.  Retroactive applicability. [This act] applies retroactively, within the meaning of 1-2-109, to voluntary income tax checkoff programs to which the contingent termination in section 1, Chapter 12, Laws of 1995, applied and that were in effect prior to January 1, 1999.
