The MontanaConstitution and Montana Code Annotated provide thata Districting and Apportionment Commission beappointed in the legislative session preceding eachfederal population census. Four members must beappointed by legislative leadership. The appointeeswere not able to select the fifth member who was appointed by the Montana Suprteme Court and who is the presidingofficer. The Constitution directs the Commission to"prepare a plan for redistricting and reapportioning thestate into legislative districts and a plan for redistrictingthe state into congressional districts."
The Commission has specific deadlines for filing final plans for congressional and legislative districts once2000 census figures are released during the first fewmonths of 2001. Congressional districts must be filed within 90 days after receipt of official final decennial census data. Legislative districts must be presented to the Legislature in the session following receipt of the official final decennial data and filed within 30 days after the Legislature returns the plan with comments.
