Montana Ballot Measures

In 2007, the Legislature passed Senate Bill 96, revising state law relating to initiatives and referenda. One of those revisions changed the involvement of the Legislative Service Division in the initiative and referendum process.

Before 2007, individuals proposing ballot measures were required to submit the text of their proposed measures first to the Legislative Services Division for review. Staff of the division were given 14 days to recommend changes to the text for clarity, consistency, and any other factors relevant to drafting legislation. The Legislative Services Division was required to furnish the Secretary of State’s Office with a copy of the measure and any recommendations regarding it.

As of 2007, state law requires proponents of ballot measures to submit their proposals directly to the Secretary of State’s Office. That office then forwards a copy of the proposed measure to the Legislative Services Division for review.
