     16-6-302. Penalty for sale of alcoholic beverage without license. Any person who has not been issued a license under this code who sells or keeps for sale any alcoholic beverage is guilty of a felony and upon conviction thereof is punishable by a fine of not less than $1,000 or more than $5,000 or by imprisonment in the state prison for not less than 1 or more than 5 years or by both such fine and imprisonment.
