25-34-302. Proceedings informal -- court reporters. (1) If the action is tried to the court, the proceedings shall be informal to the extent possible in order to dispense speedy justice to the parties. A reporter is not necessary unless the judge finds the issues sufficiently complex that a record is desirable, in which case he shall make arrangements with a court reporter of the district court to take the testimony. The judge shall make findings of fact sufficient to establish in full the basis of his judgment and shall file them with his judgment.
     (2) If a jury is impaneled, it shall try all issues of fact, and in such case there shall be a court reporter.
