     7-35-4104. Cemeteries on public lands. Incorporated cities or towns and, for unincorporated towns or villages, the board of county commissioners of the county may survey, lay out, and dedicate a portion of the public lands situated in or near the city, town, or village, not exceeding 5 acres, for cemetery and burial purposes. The survey and description thereof, together with a certified copy of the order constituting the land as a cemetery, must be recorded in the office of the county clerk of the county in which the land is located.
