A Bill for an Act entitled: "An Act repealing the Montana Cigarette Sales Act and eliminating department of revenue regulation of cigarette sales; repealing sections 16-10-101, 16-10-102, 16-10-103, 16-10-104, 16-10-110, 16-10-201, 16-10-203, 16-10-204, 16-10-205, 16-10-301, 16-10-302, 16-10-303, 16-10-304, 16-10-402, and 16-10-403, MCA; and providing an immediate effective date and an applicability date for pending actions."

Be it enacted by the Legislature of the State of Montana:

NEW SECTION. Section 1.  Repealer. Sections 16-10-101, 16-10-102, 16-10-103, 16-10-104, 16-10-110, 16-10-201, 16-10-203, 16-10-204, 16-10-205, 16-10-301, 16-10-302, 16-10-303, 16-10-304, 16-10-402, and 16-10-403, MCA, are repealed.

NEW SECTION. Section 2.  Applicability. Any pending actions commenced prior to [the effective date of this act] for violation of a provision repealed in [section 1] are void.

NEW SECTION. Section 3.  Effective date. [This act] is effective on passage and approval.
