A Bill for an Act entitled: "An Act providing limits on liability for physicians and dentists who provide care or assistance for charitable purposes; and providing an immediate effective date and an applicability date."

Be it enacted by the Legislature of the State of Montana:

NEW SECTION. Section 1.  Limits on liability of health care provider who provides services without compensation. A physician licensed under Title 37, chapter 3, or a dentist, dental surgeon, or oral surgeon licensed under Title 37, chapter 4, who, for charitable purposes, provides care or assistance without compensation or who offers services at a minimum rate to provide reimbursement for supplies and overhead costs is not liable for civil damages for acts or omissions other than damages occasioned by gross negligence or by willful or wanton acts or omissions by the physician, dentist, dental surgeon, or oral surgeon.

NEW SECTION. Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 27, chapter 1, part 7, and the provisions of Title 27, chapter 1, part 7, apply to [section 1].

NEW SECTION. Section 3.  Applicability. [This act] applies to services rendered on or after [the effective date of this act].

NEW SECTION. Section 4.  Effective date. [This act] is effective on passage and approval.
