A Bill for an Act entitled: An Act removing the requirement that experience for construction blasters be obtained in a period following and not during training; changing the experience requirement from 1 year to 2 years; and amending section 37-72-302, MCA.



Be it enacted by the Legislature of the State of Montana:



Section 1.  Section 37-72-302, MCA, is amended to read:

"37-72-302.   Training and experience requirements. (1) A person applying for licensure as a construction blaster shall furnish proof, under oath, on a form provided by the department, that he the person has:

(a)  successfully completed a training program in construction blasting that has been recognized by the explosives or construction industry and approved by the department; and

(b)  at least 1 year 2 years of posttraining experience in construction blasting and because of that experience is familiar with the practical aspects of construction blasting.

(2)  No A training program may not be approved by the department that does not offer unless the program offers comprehensive instruction in types of explosives, methods and purposes of their use, and safety and storage. The department shall by rule adopt a list of approved training programs."
