A Bill for an Act entitled: "An Act providing for the waiver of workers' compensation and occupational disease rights by self-employed individuals; and amending section

39-71-409, MCA."

Be it enacted by the Legislature of the State of Montana:

Section 1.  Section 39-71-409, MCA, is amended to read:

"39-71-409.   Waivers by employee invalid -- exception. (1) No Except as provided in subsection (2), an agreement by an employee to waive any rights under this chapter for any injury to be received shall be is not valid.

(2) An individual purporting to be an employee who is determined to be self-employed waives all rights under this chapter."
