A Bill for an Act entitled: "An Act requiring that a qualified elector for a school bond election be either a resident of the school district or the owner of taxable real property located in the school district; requiring a property owner to provide proof of voter registration; amending section

20-20-301, MCA; and providing an immediate effective date."



Be it enacted by the Legislature of the State of Montana:



Section 1.  Section 20-20-301, MCA, is amended to read:

"20-20-301.   Qualifications of elector. An individual is entitled to vote at school elections if he the individual has the qualifications set forth in 13-1-111 and is:

(1) a resident of the school district or, in a school district that has been apportioned into single-member trustee districts according to 20-3-337, a resident of the trustee district; or

(2) for bond elections held pursuant to 20-9-421, a resident of the school district or the owner of taxable real property located in the school district. An individual who is the owner of real property is not required to meet the qualifications of an elector in 13-1-111(1)(c) but must be registered to vote in the state of Montana and shall file proof of registration with the election administrator."



NEW SECTION. Section 2.  Effective date. [This act] is effective on passage and approval.
