A Bill for an Act entitled: "An Act submitting to the qualified electors of Montana an amendment to Article VIII of the Montana Constitution to limit the imposition of certain property taxes; and providing an effective date."



Be it enacted by the Legislature of the State of Montana:



Section 1. Article VIII of The Constitution of the State of Montana is amended by adding a new section 17 that reads:

Section 17. Limitation on certain property taxes. (1) If the legislature provides for a general exemption of personal property from ad valorem taxation, a property tax on personal property shall not be imposed unless approved by the electorate.

(2) A statewide property tax levy on the taxable property in the state shall not be imposed unless approved by the electorate.



NEW SECTION. Section 2.  Effective date. This amendment is effective on approval by the electorate.



NEW SECTION. Section 3.  Submission to electorate. This amendment shall be submitted to the qualified electors of Montana at the general election to be held in November 1998 by printing on the ballot the full title of this act and the following:

[] AGAINST limiting the imposition of certain property taxes.
