A Bill for an Act entitled: "An Act revising the laws relating to construction standards for recreational vehicles; eliminating the responsibility of the department of commerce for adopting construction standards for recreational vehicles; adopting the American national standards institute construction standard for recreational vehicles; and amending sections 50-60-104, 50-60-401, 50-60-402, and 50-60-403, MCA."



Be it enacted by the Legislature of the State of Montana:



Section 1.  Section 50-60-104, MCA, is amended to read:

"50-60-104.   Inspection fees. The department shall establish a schedule of fees and may collect fees for the inspection of plans and specifications and for the inspection of buildings, factory-built buildings, recreational vehicles, tramways, or any other facility or structure."



Section 2.  Section 50-60-401, MCA, is amended to read:

"50-60-401.   Department to adopt rules for factory-built buildings and recreational vehicles. The department may adopt by reference nationally recognized construction standards, in whole or in part, for the construction of factory-built buildings, but this does not prevent the department from adopting rules more stringent than those contained in such the national standards, for the construction of factory-built buildings and recreational vehicles as defined in 50-60-101."



Section 3.  Section 50-60-402, MCA, is amended to read:

"50-60-402.   Factory-built buildings and recreational vehicles to comply with standards. (1) No A person, firm, or corporation may not manufacture, sell, or offer for sale any new factory-built building or recreational vehicle unless such the factory-built building or recreational vehicle, and its components, systems, and appliances have been constructed and assembled in accordance with the standards herein defined in this part.

(2)  Any A factory-built building or recreational vehicle unit which that has been approved by the department shall be deemed is considered to be in full compliance with the standards and rules prescribed in parts 1 through 4.

(3)  All factory-built buildings or recreational vehicle units thus approved by the department shall be are acceptable as meeting the requirements of parts 1 through 4 throughout the state of Montana without further inspection or fees except for zoning, utility connections, and foundation permits required by local ordinance.

(4) A person, firm, or corporation may not manufacture, sell, or offer for sale a new recreational vehicle unless the vehicle has been constructed and assembled in accordance with the American national standards institute ANSI/A119.2 standard for recreational vehicles. The department is not responsible for enforcing the compliance of recreational vehicles with the ANSI/A119.2 standard as part of the state building code."



Section 4.  Section 50-60-403, MCA, is amended to read:

"50-60-403.   Use of independent testing laboratories authorized. The department may utilize use independent testing laboratories or the agencies of other states to determine if approved models of factory-built buildings or recreational vehicles are being constructed in accordance with the approved plans and specifications for said those models."
