     39-72-206. Legal action by department. Upon request of the department, the attorney general shall institute and prosecute actions for the enforcement of the provisions of this chapter or for any penalty provided for in this chapter. The attorney general shall prosecute or defend all actions brought by or against the department in its official capacity. The department may compromise any action brought under this chapter.
