19-5-501. Eligibility for service retirement. (1) Any member who has at least 5 years of membership service and has reached the age of 65 may retire and receive the proportional retirement benefits provided in 19-5-502.
     (2) Retirement benefits may not be approved by the board while the member is drawing full compensation as a judge or justice. However, benefits may not be withheld for receiving compensation as a judge pro tempore.
