     50-71-315. Variations to code. (1) In case of practical difficulties, the department may grant variations from particular provisions of the code and permit the use of other or different devices or methods. However, such variations shall be granted only when it is clear that the reasonable safety of the workers in the plant or place of employment is not thereby endangered.
     (2) In any case where the department shall decline or refuse to grant any request for variations on the ground that the safety of the workers involved would be endangered, the employer may request a rehearing as specified in this chapter.
     (3) A properly indexed record of all variations made shall be kept in the office of the department and be open to public inspection.
