(1) Eligibility for FAIM financial assistance under the FAIM project with regard to income, resources, and all other factors of eligibility must be determined in accordance with the waivers granted by the U.S. secretary of health and human services under section 1115 of the Social Security Act, 42 U.S.C. 1315.
     (2) (a) As a condition of eligibility for assistance under pathways and the community services program, all specified caretaker relatives and other family members, as specified by the department by rule, shall enter into a family investment agreement with the department and shall comply with the terms of that agreement.      (ii) requiring that the immunization and health-screening requirements of the early and periodic screening, diagnosis, and treatment program be met for all children in the family; and
(iii) specifying other services and activities appropriate for the participant or family.
     (c) An individual who is required to enter into a family investment agreement and who fails without good cause to do so or fails without good cause to comply with the individual's obligations under the agreement is ineligible, as provided in 53-4-608, for FAIM financial assistance.
     (3) As a condition of eligibility for the community service program, a specified caretaker relative shall perform community service work as required by the department.
