A BILL FOR AN ACT ENTITLED: "AN ACT SUBMITTING TO THE QUALIFIED ELECTORS OF MONTANA AN AMENDMENT TO ARTICLE XII, SECTION 2, OF THE MONTANA CONSTITUTION TO ELIMINATE THE CONSTITUTIONAL STATUS OF THE DEPARTMENT OF LABOR AND INDUSTRY."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Article XII, section 2, of The Constitution of the State of Montana is amended to read:

"Section 2.  Labor Hours of work. (1)  The legislature shall provide for a Department of Labor and Industry, headed by a Commissioner appointed by the governor and confirmed by the senate.

(2)  A maximum period of 8 hours is a regular day's work in all industries and employment except agriculture and stock raising. The legislature may change this maximum period to promote the general welfare."



     NEW SECTION.  Section 2.  Submission to electorate. This amendment shall be submitted to the qualified electors of Montana at the general election to be held in November 2002 by printing on the ballot the full title of this act and the following:

     [] FOR eliminating the constitutional status of the department of labor and industry.

     [] AGAINST eliminating the constitutional status of the department of labor and industry.
