A BILL FOR AN ACT ENTITLED: "AN ACT SUBMITTING TO THE QUALIFIED ELECTORS OF MONTANA AN AMENDMENT TO ARTICLE XII, SECTION 1, OF THE MONTANA CONSTITUTION TO ELIMINATE THE CONSTITUTIONAL STATUS OF THE DEPARTMENT OF AGRICULTURE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Article XII, section 1, of The Constitution of the State of Montana is amended to read:

"Section 1.  Agriculture. (1)  The legislature shall provide for a Department of Agriculture and enact laws and provide appropriations to protect, enhance, and develop all agriculture.

(2)  Special levies may be made on livestock and on agricultural commodities for disease control and indemnification, predator control, and livestock and commodity inspection, protection, research, and promotion. Revenue derived shall be used solely for the purposes of the levies."



     NEW SECTION.  Section 2.  Submission to electorate. This amendment shall be submitted to the qualified electors of Montana at the general election to be held in November 2002 by printing on the ballot the full title of this act and the following:

     [] FOR eliminating the constitutional status of the department of agriculture.

     [] AGAINST eliminating the constitutional status of the department of agriculture.
