A BILL FOR AN ACT ENTITLED: "AN ACT LIMITING SCHOOL DISTRICT GENERAL FUND EXPENSES RELATED TO GENERAL ADMINISTRATION, BUSINESS SERVICES, SCHOOL ADMINISTRATION, AND EXTRACURRICULAR ACTIVITIES AND ATHLETICS; REQUIRING VOTER APPROVAL FOR EXPENSES THAT EXCEED THE LIMITATION; ALLOWING A SCHOOL DISTRICT TO ACCEPT MONEY FROM OTHER SOURCES FOR ADMINISTRATIVE EXPENSES; AND PROVIDING A DELAYED EFFECTIVE DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Separate accounting for certain administrative expenses -- limitation on expenditure amount. (1) The trustees of a district shall provide a separate accounting within the district general fund for the purpose of recording certain district expenses incurred for general administration support services, business support services, and school administration support services, as defined in the most recent edition of the Montana School Accounting Manual issued by the superintendent of public instruction.

     (2) The trustees of a district shall limit the general fund expenditures for the current school fiscal year for the administrative expenses described in subsection (1) to the average of the actual expenditures for those budget items in the 5 school fiscal years preceding the current year.

     (3) The trustees of a district may accept gifts, grants, or contributions for use in funding administrative expenses. Any money received must be deposited in the miscellaneous programs fund of the school district.

     (4) If the trustees desire to expend an amount in excess of the limitation in subsection (2), the trustees shall submit a proposition to the electors in the district. An election called pursuant to this subsection must be called and conducted in the manner prescribed by this title for school elections. The ballot for a proposition must provide "for" and "against" provisions, stating whether the trustees are authorized to exceed the limitation in subsection (2).



     NEW SECTION.  Section 2.  Separate accounting for extracurricular activities expenses -- limitation on expenditure amount. (1) The trustees of a district shall provide a separate accounting within the district general fund for the purpose of recording certain district expenses incurred for extracurricular activities and extracurricular athletics, as defined in the most recent edition of the Montana School Accounting Manual issued by the superintendent of public instruction.

     (2) The trustees of a district shall limit the general fund expenditures for the current school fiscal year for the extracurricular expenses described in subsection (1) to the average of the actual expenditures for those budget items in the 5 school fiscal years preceding the current year.

     (3) If the trustees desire to expend an amount in excess of the limitation in subsection (2), the trustees shall submit a proposition to the electors in the district. An election called pursuant to this subsection must be called and conducted in the manner prescribed by this title for school elections. The ballot for a proposition must provide "for" and "against" provisions, stating whether the trustees are authorized to exceed the limitation in subsection (2).



     NEW SECTION.  Section 3.  Codification instruction. [Sections 1 and 2] are intended to be codified as an integral part of Title 20, chapter 9, part 1, and the provisions of Title 20, chapter 9, part 1, apply to [sections 1 and 2].



     NEW SECTION.  Section 4.  Effective date. [This act] is effective July 1, 2002.
