A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING FOR THE DEPARTMENT OF PUBLIC HEALTH AND HUMAN SERVICES TO IMPLEMENT A PROGRAM FOR THE BULK PURCHASE OF PRESCRIPTION DRUGS FOR RECIPIENTS OF PUBLICLY FUNDED MENTAL HEALTH SERVICES."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Medication purchase program for public mental health patients. (1) The legislature finds that it is in the best interest of the public mental health system to provide a cost-effective method for recipients of publicly funded mental health services to purchase their medications at the same cost as patients committed to the Montana state hospital. The cost savings to the state by developing this program is intended to fund the administration of the program.

     (2) The department of public health and human services shall implement a program that allows persons who are eligible for public mental health services under 53-6-131(1) and (10) to purchase drugs that have been supplied through a bulk purchase program administered by the department in conjunction with the department of administration.

     (3) The department of public health and human services shall coordinate its program to provide for interagency cooperation with the departments of administration and corrections in establishing a coordinated bulk ordering program and facilities located across the state for the stocking, storage, and dispensing of prescription drugs.



     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 53, chapter 21, and the provisions of Title 53, chapter 21, apply to [section 1].
