HOUSE JOINT RESOLUTION NO. 17

A JOINT RESOLUTION OF THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF MONTANA REQUESTING THAT AN APPROPRIATE INTERIM COMMITTEE BE ASSIGNED OR SUFFICIENT STAFF RESOURCES BE DIRECTED TO REVIEW ISSUES RELATED TO JUVENILE DETENTION MANAGEMENT AND GOVERNANCE.



     WHEREAS, the Legislative Audit Division conducted a performance audit of juvenile detention in Montana; and

     WHEREAS, the October 2000 Performance Audit Report identified numerous issues related to juvenile detention management and governance; and

     WHEREAS, an interim legislative study is the most appropriate means of addressing the various issues identified by the performance audit.



NOW, THEREFORE, BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF MONTANA:

     That the Legislative Council be requested to designate an appropriate interim committee, pursuant to section 5-5-217, MCA, or direct sufficient staff resources to study the following issues related to juvenile detention management and governance:

     (1) the legislative history related to establishing regional juvenile detention centers and the federal requirements related to sight and sound separation of adults and juveniles in detention;

     (2) the growth and operation of regional juvenile detention centers since the enactment of legislation in 1991;

     (3) the use of secure detention or nonsecure detention and the appropriateness of varying levels of state grant reimbursements;

     (4) the adequacy, coordination, and appropriateness of compliance monitoring and facility licensing by state agencies; and

     (5) the adequacy of state grant awards to juvenile detention centers.

     BE IT FURTHER RESOLVED, that the study result in a recommendation of where and how Montana juvenile detention should be administered at the state level.

     BE IT FURTHER RESOLVED, that if the study is assigned to staff, any findings or conclusions be presented to and reviewed by the appropriate interim committee as designated by the Legislative Council.

     BE IT FURTHER RESOLVED, that all aspects of the study, including presentation and review requirements, be concluded prior to September 15, 2002.

     BE IT FURTHER RESOLVED, that the final results of the study, including any findings, conclusions, comments, or recommendations of the appropriate interim committee, be reported to the 58th Legislature.
