A BILL FOR AN ACT ENTITLED: "AN ACT REVISING THE FAIR CAMPAIGN PRACTICES LAW; REQUIRING THE TEXT OF ELECTION MATERIAL PREPARED FOR PUBLICATION OR BROADCAST TO BE FILED WITH THE COMMISSIONER OF POLITICAL PRACTICES PRIOR TO PUBLICATION OR BROADCAST; REQUIRING THE TEXT TO BE ACCOMPANIED BY AN AFFIDAVIT STATING THAT THE CONTENT OF THE MATERIAL HAS BEEN CHECKED AND VERIFIED FOR THE ACCURACY OF THE CONTENT OF THE MATERIAL; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Filing of text of political advertising -- affidavit. Prior to being published or broadcast, a copy of the text of election material referred to in 13-35-225 must be filed with the commissioner of political practices. The text of the election material must be accompanied by an affidavit stating that the content of the material, including any facts or allegations, has been checked and verified for the accuracy of the content of the material. The affidavit must be signed by the person making or financing the expenditure for the communication of the material. In the case of election material proposed to be published or broadcast by a political committee or political party, the affidavit must be signed by the treasurer of the committee or party.



     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 13, chapter 35, part 3, and the provisions of Title 13, chapter 35, part 3, apply to [section 1].



     NEW SECTION.  Section 3.  Effective date. [This act] is effective on passage and approval.
