A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING THE LEGISLATIVE COUNCIL AND THE LEGISLATIVE FINANCE COMMITTEE TO ADOPT POLICIES REQUIRING THAT BILL SUMMARIES BE PREPARED FOR INTRODUCED BILLS."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Legislative council and legislative finance committee to adopt policies requiring bill summaries -- no basis for legal claim or action. (1) The legislative council shall adopt a policy requiring that a summary be prepared by the legislative services division for each introduced bill that is not a general appropriation bill.

     (2) The legislative finance committee shall adopt a policy requiring the legislative finance division to prepare a summary for each introduced bill that is a general appropriation bill.

     (3) Each bill summary must be objective in nature, apply to the bill in its introduced form, and contain a short description of the provisions of the bill and arguments for and against the passage of the bill. The summary of a general appropriation bill or a bill implementing the recommendations of the code commissioner made pursuant to 1-11-204(1) may be as long as necessary.

     (4) The provisions of a bill summary, or the failure to prepare a bill summary, is not a basis for a legal action or claim concerning a bill introduced in or passed by the legislature.
