A BILL FOR AN ACT ENTITLED: "AN ACT ESTABLISHING THE SCHOOL CAFETERIA ASSISTANCE AND FOOD EQUIPMENT PROGRAM; ESTABLISHING CRITERIA FOR PARTICIPATION IN THE PROGRAM; REQUIRING A LOCAL MATCH FOR STATE FUNDS; AND PROVIDING AN EFFECTIVE DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Short title. [Sections 1 and 2] may be cited as the "School Cafeteria Assistance and Food Equipment Program Act".



     NEW SECTION.  Section 2.  CAFE program -- eligibility -- funding. (1) As used in this section, "CAFE" means the school cafeteria assistance and food equipment program established in this section.

     (2)  The CAFE program provides additional resources to a school district that offers food services to its students. In order to participate in the CAFE program, a school district shall operate a school breakfast or a school lunch program.

     (3)  The superintendent of public instruction shall annually award a block grant to each eligible school district that participates in the CAFE program. The annual block grant may not exceed $10,000. A school district shall provide a local contribution for the CAFE program, matching every $10 of state block grant with one local dollar.

     (4)  A school district that receives funding from the CAFE program shall expend the funds directly on a school breakfast or a school lunch program.



     NEW SECTION.  Section 3.  Codification instruction. [Sections 1 and 2] are intended to be codified as an integral part of Title 20, chapter 10, part 2, and the provisions of Title 20, chapter 10, part 2, apply to [sections 1 and 2].



     NEW SECTION.  Section 4.  Effective date. [This act] is effective July 1, 2001.
