SENATE JOINT RESOLUTION NO. 6

A JOINT RESOLUTION OF THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF MONTANA THAT AN INTERIM COMMITTEE BE ASSIGNED OR SUFFICIENT STAFF RESOURCES BE DIRECTED TO STUDY AND REVISE TRAFFIC CODES TO PROVIDE CLARITY AND UNIFORMITY; AND REQUESTING THAT A BILL BE PREPARED CONTAINING THE PROPOSED REVISIONS TO PRESENT TO THE 58TH LEGISLATURE.



     WHEREAS, traffic regulation statutes found in Title 61, chapter 8, of the Montana Code Annotated have ambiguities that warrant clarification; and

     WHEREAS, the traffic codes have not been kept current with the revisions in the Uniform Vehicle Code; and

     WHEREAS, it is in the public's interest for there to be clarity and uniformity in the state's traffic laws.



NOW, THEREFORE, BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF MONTANA:

     That the Legislative Council designate an appropriate interim committee or direct sufficient staff resources to:

     (1) study the existing traffic laws contained in Title 61, chapter 8, Montana Code Annotated, to identify areas of ambiguity;

     (2)  compare the existing traffic laws to the currently existing Uniform Vehicle Code;

     (3)  identify differences between the laws contained in Title 61, chapter 8, Montana Code Annotated, and the provisions of the Uniform Vehicle Code for the purposes of preparing legislation to present to the 58th Legislature.

     BE IT FURTHER RESOLVED, that the constructive input of the Department of Transportation, the Department of Justice, local government representatives, and other interested persons be sought in the process of evaluating the current traffic laws and recommending changes to those laws.

     BE IT FURTHER RESOLVED, if staff resources are directed to conduct the study, that the staff assigned to the study report on a regular basis to an appropriate interim committee designated by the Legislative Council.

     BE IT FURTHER RESOLVED, that draft legislation be prepared for presentation to the 58th Legislature that encompasses any proposed changes to the current laws resulting from this study.
