HOUSE BILL NO. 37

A BILL FOR AN ACT ENTITLED: "AN ACT REVISING THE TIME PERIOD AND THE MANNER IN WHICH THE COMMISSIONER OF POLITICAL PRACTICES PROVIDES CERTAIN INFORMATION TO THE PUBLIC; REQUIRING REVENUE FROM COPYING CHARGES TO BE DEPOSITED IN THE GENERAL FUND; AND AMENDING SECTION 13-37-119, MCA."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

            Section 1.  Section 13-37-119, MCA, is amended to read:

            "13-37-119.  Availability of information. (1) The commissioner shall make statements and other information filed with his the commissioner's office available for public inspection and copying during regular office hours pursuant to 2-6-104 and make copying facilities available free of charge or at a charge not to exceed actual cost. Copies must be provided upon request within a reasonable period of time and at a charge calculated for materials and equipment determined by the averaged charges of three local copying shops for equal services. Labor for copying must be provided only by the commissioner's staff and must be billed according to the hourly rate for the current fiscal year for a state employee classified as grade 10, market salary, under 2-18-312 for each hour, or fraction of an hour, of copying service.

            (2)  The commissioner shall preserve statements and other information filed with his the commissioner's office for a period of 10 years from date of receipt.

            (3)  The commissioner shall prepare and publish summaries of the statements received and such other reports as he that the commissioner considers appropriate.

            (4)  The commissioner shall provide for wide public dissemination of these summaries and reports.

            (4) Revenue received for copying must be deposited in the general fund."
