A BILL FOR AN ACT ENTITLED: "AN ACT CREATING THE OFFENSE OF CONTRACTOR THEFT."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Contractor theft. A person commits the offense of contractor theft if the person knowingly receives from another person money that is to be used to obtain materials, equipment, or labor or other services for a construction project and fails to use the money for that purpose. A person convicted of contractor theft shall be punished as provided in 45-6-301.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 45, chapter 6, part 3, and the provisions of Title 45 apply to [section 1].
