A BILL FOR AN ACT ENTITLED: "AN ACT CLARIFYING THAT A PERSON RESIDING IN YELLOWSTONE NATIONAL PARK AS A CONDITION OF EMPLOYMENT MAY REGISTER TO VOTE IN PARK COUNTY OR GALLATIN COUNTY AND MAY VOTE IN STATE AND LOCAL ELECTIONS; AMENDING SECTIONS 13-1-111 AND 13-2-208, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE AND A RETROACTIVE APPLICABILITY DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 13-1-111, MCA, is amended to read:

     "13-1-111.  Qualifications of voter. (1) No In order to person may be entitled to vote at elections, unless he a person has must have the following qualifications:

     (a)  He the person must be registered as required by law.;

     (b)  He the person must be 18 years of age or older.;

     (c)  He subject to subsection (4), the person must be a resident of the state of Montana and of the county in which he the person offers to vote for at least 30 days.; and

     (d)  He the person must be a citizen of the United States.

     (2)  No A person convicted of a felony has the right to may not vote while he the person is serving a sentence in a penal institution of incarceration.

     (3)  No A person adjudicated to be of unsound mind has the right to may not vote, unless he the person has been restored to capacity as provided by law.

     (4) A person who resides in Yellowstone national park as a condition of employment and whose nearest polling place is in Park County or Gallatin County may register in Park County or Gallatin County and may vote in state and local elections. The person may not vote in both Montana and Wyoming."

 

     Section 2.  Section 13-2-208, MCA, is amended to read:

     "13-2-208.  Elector to furnish residential address -- prohibiting registration for failure to provide address. (1) An elector shall provide the election administrator with the elector's current street address, rural address, or, if neither of those addresses is available, other specific geographic location information from which the location of the elector's residence may be easily determined by the election administrator.

     (2)  The Except as provided in subsection (3), the election administrator may not register an elector who fails to provide the information required by subsection (1).

     (3) An elector, the elector's spouse, and the elector's voting-age dependents who reside in Yellowstone national park as a condition of the elector's employment and whose closest polling place is in Park County or Gallatin County shall provide the election administrator with sufficient information to allow the election administrator to register them to vote. However, the election administrator may not refuse to register an elector described in this subsection for failure to provide the information required by subsection (1)."

 

     NEW SECTION.  Section 3.  Effective date. [This act] is effective on passage and approval.

 

     NEW SECTION.  Section 4.  Retroactive applicability. [This act] applies retroactively, within the meaning of 1-2-109, to the registration of electors residing in Yellowstone national park as a condition of employment.
