HOUSE BILL NO. 622

A BILL FOR AN ACT ENTITLED: "AN ACT REVISING THE ELECTRICAL WIRING REQUIREMENTS FOR COMMERCIAL BUILDINGS; PROVIDING AN EXCEPTION; AND AMENDING SECTION 50-60-603, MCA."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 50-60-603, MCA, is amended to read:

     "50-60-603.  Electrical codes to be adopted by department by rule -- prohibited wiring. (1) The department of labor and industry shall adopt rules relating to the installation of wires and equipment to convey electrical current and installations of apparatus to be operated by current, except as provided in 50-60-602.

     (2)  The department may adopt by reference the national fire protection association standard NFPA 70, national electrical code, in whole or in part, and may adopt rules more stringent than those in the national fire protection association standard NFPA 70, national electrical code.

     (3) It is unlawful for a person, partnership, company, firm, association, corporation, or other legal entity to install nonmetallic sheathed cable, commonly referred to as romex, in commercial buildings if the cable installation is inaccessible unless the cable installation is only necessary for providing temporary power during construction of the building. For the purpose of this subsection, the term "commercial building" does not include any individual or multiple residential living complex. A person who violates this subsection is guilty of a misdemeanor."
