A BILL FOR AN ACT ENTITLED: "AN ACT TRANSFERRING $1.5 MILLION IN FISCAL YEARS 2004 AND 2005 FROM THE GENERAL FUND TO THE SCHOOL FLEXIBILITY ACCOUNT, CONTINGENT UPON A $3 MILLION REDUCTION IN THE HOUSE BILL NO. 2 APPROPRIATION TO THE OFFICE OF PUBLIC INSTRUCTION'S TOTAL GENERAL FUND BUDGET FROM THE AMOUNT APPROPRIATED FOR THE BIENNIUM ENDING JUNE 30, 2003; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Transfer of money -- contingency. (1) Subject to subsection (2), there is transferred $1.5 million in fiscal year 2004 and $1.5 million in fiscal year 2005 from the general fund to the school flexibility account established in 20-9-542.
(2) The transfer authorized in subsection (1) is effective only if the appropriation in House Bill No. 2 is $3 million less to the office of public instruction's total general fund budget than was appropriated for the biennium ending June 30, 2003.
NEW SECTION. Section 2. Effective date. [This act] is effective on passage and approval.
