A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING THE DEPARTMENT OF ADMINISTRATION TO IMPLEMENT A PROGRAM FOR THE BULK PURCHASE OF PRESCRIPTION DRUGS FOR RECIPIENTS OF PUBLICLY FUNDED MENTAL HEALTH SERVICES AND FOR RECIPIENTS OF MEDICAID AND MEDICARE FOR DISPENSING BY LOCAL PHARMACIES; AND PROVIDING AN EFFECTIVE DATE AND A TERMINATION DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Medication purchase program -- public mental health patients -- medicaid and medicare recipients. (1) The legislature finds that it is in the best interest of the public mental health and health care systems to provide a cost-effective method for recipients of publicly funded mental health services, medicaid, or medicare to purchase their medications at the same cost as patients committed to Montana state institutions. The cost savings to the state by developing this program are intended to fund the administration of the program and to provide additional funding for health-related programs administered by the department of public health and human services.

     (2) The department of administration shall implement a program to purchase drugs through a bulk purchase program administered by the department in conjunction with the department of public health and human services for dispensing to persons who are eligible for:

     (a) public mental health services;

     (b) medicaid under 53-6-131; or

     (c) the federal medicare program.

     (3) The department of administration shall coordinate its program to provide for interagency cooperation with the departments of public health and human services and corrections in establishing a coordinated bulk ordering program to supply local pharmacies for the dispensing of prescription drugs to eligible persons.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 18, chapter 5, and the provisions of Title 18, chapter 5, apply to [section 1].

 

     NEW SECTION.  Section 3.  Effective date. [This act] is effective July 1, 2003.

 

     NEW SECTION.  Section 4.  Termination. [This act] terminates June 30, 2008.
