HOUSE BILL NO. 685

A BILL FOR AN ACT ENTITLED: "AN ACT ALLOWING A SCHOOL DISTRICT TO COUNT STUDENTS IN A CHILD-CARE AGENCY--RESIDENTIAL TREATMENT CENTER CERTAIN FACILITY IN THE DISTRICT'S ANB COUNT; AND PROVIDING AN EFFECTIVE DATE, AN APPLICABILITY DATE, AND A TERMINATION DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  ANB for students in certain facilities. A school district with a CHILD-CARE AGENCY--residential treatment center FACILITY for school-aged children located within the district's boundaries may include a student in the treatment center in the district's ANB ENROLLMENT count A STUDENT WHO IS UNDER THE PROTECTIVE CARE OF A STATE AGENCY OR HAS BEEN ADJUDICATED BY A MONTANA COURT TO BE A YOUTH IN NEED OF INTERVENTION OR A DELINQUENT YOUTH, AS DEFINED IN 41-5-103, OR A STUDENT WHO IS REQUIRED TO ATTEND SCHOOL OUTSIDE OF THE DISTRICT OF RESIDENCE AS THE RESULT OF A PLACEMENT IN FOSTER CARE OR IN A GROUP HOME LICENSED BY THE STATE if:

     (1) THE CHILD-CARE AGENCY--RESIDENTIAL TREATMENT CENTER FACILITY IS LICENSED BY THE STATE AS A YOUTH GROUP HOME THAT PROVIDES THERAPEUTIC SERVICES;

     (1)(2) the district retains written verification from the CHILD-CARE AGENCY--residential treatment center FACILITY documenting the student's participation in the CHILD-CARE AGENCY--RESIDENTIAL treatment center's FACILITY'S education program on the date that enrollment is counted;

     (2)(3) the CHILD-CARE AGENCY--residential treatment center has applied for accreditation for its education program from the board of public education;

     (3)(4)(3) all of the teachers in the CHILD-CARE AGENCY--residential treatment center's FACILITY'S education program are certified, as provided in 20-4-101; AND

     (4) the residential treatment center is licensed by the state as a youth group home that provides therapeutic services; and

     (5)(4) the school district has entered into a contractual agreement with the CHILD-CARE AGENCY --residential treatment center FACILITY to provide educational services to the students in the center.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 20, chapter 9, part 3, and the provisions of Title 20, chapter 9, part 3, apply to [section 1].

 

     NEW SECTION.  Section 3.  Effective date -- applicability. [This act] is effective July 1, 2003, AND APPLIES TO SCHOOL BUDGETS FOR SCHOOL FISCAL YEARS BEGINNING ON OR AFTER JULY 1, 2003.

 

     NEW SECTION.  Section 4.  Termination. [This act] terminates June 30, 2005.
