A BILL FOR AN ACT ENTITLED: "AN ACT REDUCING THE PERSONAL SERVICES BUDGET OF THE DEPARTMENT OF PUBLIC HEALTH AND HUMAN SERVICES BY $2 MILLION IN GENERAL FUND MONEY FOR EACH FISCAL YEAR IN ORDER TO TRANSFER THE MONEY FOR MENTAL HEALTH PRESCRIPTION DRUG FUNDING; AND PROVIDING AN EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Transfer of money -- contingency. (1) Except as provided in subsection (2), there is transferred $2 million in fiscal year 2004 and $2 million in fiscal year 2005 in general fund money from the personal services budget of the department of public health and human services to be used to fund prescription drugs for persons being served in community-based mental health programs. The reduction in personal services funding must be applied first to Helena-based, full-time equivalent employees.

     (2) The transfer authorized in subsection (1) is effective only if the 2005 biennial general fund appropriation for personal services in state level activities for the department of public health and human services in House Bill No. 2 is $4 million less than what was appropriated for the biennium ending June 30, 2003.

 

     NEW SECTION.  Section 2.  Effective date. [This act] is effective July 1, 2003.
