A BILL FOR AN ACT ENTITLED: "AN ACT PROHIBITING THE BOARD OF TRUSTEES OF A HIGH SCHOOL OR K-12 SCHOOL DISTRICT FROM JOINING AN ORGANIZATION UNLESS THE ORGANIZATION ADOPTS A POLICY APPLYING THOSE PORTIONS OF THE CRITERIA USED TO DETERMINE THE ELIGIBILITY FOR PARTICIPATION IN EXTRACURRICULAR ACTIVITIES OF A STUDENT RECEIVING SERVICES UNDER THE INDIVIDUALS WITH DISABILITIES EDUCATION ACT OR THE REHABILITATION ACT OF 1973 THAT ARE RELEVANT TO ALL STUDENTS WHO ARE 19 YEARS OF AGE AND ENROLLED FULL-TIME IN A SCHOOL IN THE DISTRICT; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Membership in organization without participation policy for all nineteen-year old students prohibited. The trustees of a high school district, as defined in 20-6-101, or a K-12 school district, as defined in 20-6-701, may not elect to join an organization unless the organization adopts a policy applying those portions of the criteria used to determine the eligibility for participation in extracurricular activities of a student receiving services under the Individuals With Disabilities Education Act, 20 U.S.C. 1400, et seq., or the Rehabilitation Act of 1973, 29 U.S.C. 794, that are relevant to all students who are 19 years of age and enrolled full-time in a school in the district.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 20, chapter 1, part 2, and the provisions of Title 20, chapter 1, part 2, apply to [section 1].

 

     NEW SECTION.  Section 3.  Effective date. [This act] is effective on passage and approval.
