     7-35-4107. Jurisdiction and control of cemeteries. The general management, conduct, and regulation of interments, permits to inter or remove interred bodies, and the disposition of lots, keeping the same in order, are under the jurisdiction and control of:
     (1) the cities and towns owning the same if incorporated; or
     (2) the board of county commissioners of the county in which they are situated, if not incorporated.
